1. Acceptance of Terms

By accessing or using Dietary Signals ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

Dietary Signals is a Metabolic Health Intelligence Platform that delivers personalized metabolic clarity — helping you understand your body's signals, detect repeatable patterns, and make confident decisions before you eat. The App serves individuals across diverse health goals, including wellness seekers, athletes, those managing prediabetes or type 2 diabetes, and GLP-1 medication users. It integrates with optional CGM (Continuous Glucose Monitor) and BGM (Blood Glucose Meter) devices via Apple HealthKit to deepen your metabolic insight over time.

3. User Responsibilities

You agree to:

• Provide accurate and complete health information
• Use the App only for lawful purposes
• Not share your account credentials with others
• Consult healthcare professionals before making dietary changes
• Understand that recommendations are suggestions, not medical directives
• Be at least 18 years of age or have parental consent

4. Age Requirements

Alcohol Features: Wine pairing features are only available to users who confirm they are 21+ years of age. You must provide accurate age information. Misrepresenting your age is a violation of these Terms.

General Use: You must be at least 13 years old to use this App. Users under 18 must have parental or guardian consent.

5. Subscription and Payments

5.1 Subscription Tiers

• FREE — Start Understanding: 10 photo scans and 30 text analyses per month with standard meal analysis
• PLUS — See Your Patterns ($12.99/month or $99.99/year): 75 photo scans, 150 text analyses, pattern-level metabolic clarity, CGM integration (LibreLinkUp, Dexcom Share, Apple Health), sleep & stress context, wine recommendations
• PREMIUM — Full Metabolic Clarity ($24.99/month or $199.99/year): 150 photo scans, 300 text analyses, all Plus features, GLP-1 full suite with protein tracking and injection timing, priority processing and support

5.2 Payment Terms

• Subscriptions are billed monthly through your Apple ID account
• Payment charged to your Apple ID at confirmation of purchase
• Subscription automatically renews unless canceled at least 24 hours before end of current period
• Auto-renewal can be turned off in Apple ID Account Settings
• No refunds for unused portions of subscriptions

5.3 Free Trial

Free tier provides 10 photo scans and 30 text analyses per month. After upgrade, you will be charged the subscription fee. Cancel anytime before renewal to avoid charges.

6. Accuracy of Information

While we strive for accuracy, Dietary Signals:

• Cannot guarantee 100% accuracy in metabolic signal analysis
• Uses pattern recognition technology that may have limitations
• Provides estimates based on typical food compositions and your personal metabolic patterns
• Cannot account for every recipe variation or preparation method
• Should not be used as the sole basis for dietary or health decisions

7. User Content and Data

7.1 Your Content

You retain ownership of any photos, notes, or data you provide to the App. By using the App, you grant us a limited license to use this content solely to provide our services.

7.2 Data Privacy

Your use of the App is also governed by our Privacy Policy. We do not sell your personal health data to third parties.

8. Prohibited Uses

You may NOT:

• Use the App for any illegal purpose
• Attempt to reverse engineer or copy the App
• Share or resell App subscriptions
• Upload malicious code or viruses
• Scrape or harvest data from the App
• Impersonate other users or entities
• Use the App if you're under 13 years old

9. AI Features & Acceptable Use

9.1 Acceptable Use of AI Features

You agree to use AI-powered features only for lawful, personal, and non-commercial purposes. You may not:

• Use automated systems, scripts, or bots to interact with AI features
• Attempt to bypass, disable, or interfere with usage limits or safeguards
• Submit content intended to overload, disrupt, or misuse the service
• Attempt to extract system instructions, model behavior, or internal logic

9.2 Usage Limits & Availability

Dietary Signals may apply usage limits, throttling, or other controls to ensure fair use, system reliability, and cost management. We do not guarantee uninterrupted availability of AI-powered features. We may modify or discontinue AI-powered features at any time without notice.

9.3 Monitoring & Enforcement

We reserve the right to monitor usage patterns and to restrict, suspend, or terminate access to AI features if we detect activity that violates these Terms or threatens the integrity of the service.

9.4 Metabolic Insights Disclaimer

Metabolic insights, pattern analysis, and personalized suggestions are provided "as is" for informational purposes only. Dietary Signals does not guarantee the accuracy, completeness, or suitability of any insight or suggestion for any particular purpose.

10. Intellectual Property

Dietary Signals, its logo, and all related content are protected by copyright, trademark, and other intellectual property laws. You may not use our branding without written permission.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The App is provided "AS IS" without warranties of any kind
• We are not liable for any health outcomes resulting from App use
• We are not responsible for decisions you make based on App suggestions
• Our total liability shall not exceed the amount you paid for the subscription
• We are not liable for indirect, incidental, or consequential damages

12. Indemnification

You agree to indemnify and hold harmless Dietary Signals from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

13. Account Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent activity
• Misuse the App in ways that harm other users
• Provide false age or health information

You may delete your account at any time through the App settings.

14. Changes to Terms

We may modify these Terms at any time. Significant changes will be communicated through:

• In-app notification
• Email to your registered address
• Updated "Last Modified" date

Continued use of the App after changes constitutes acceptance of new Terms.

15. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.

16. Dispute Resolution

Any disputes arising from these Terms or App use shall be resolved through:

• Good faith negotiation
• Binding arbitration if negotiation fails
• Arbitration conducted in Travis County, Texas
• You waive the right to participate in class action lawsuits

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.
